T\u00fcrk Medeni Kanunu&#8217;na g\u00f6re kira, bir \u015feyin kullan\u0131m hakk\u0131n\u0131n bir bedel kar\u015f\u0131l\u0131\u011f\u0131nda ba\u015fkas\u0131na b\u0131rak\u0131lmas\u0131d\u0131r. <\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">T\u00fcrkiye&#8217;de kira hukuku zaman i\u00e7inde de\u011fi\u015fime u\u011fram\u0131\u015f ve geli\u015fmi\u015ftir. \u00d6zellikle son y\u0131llarda, kira hukukunda yap\u0131lan yasal d\u00fczenlemeler ile birlikte kiralama i\u015flemleri ve taraflar\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fckleri yeniden d\u00fczenlenmi\u015ftir.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Kira s\u00f6zle\u015fmeleri, taraflar\u0131n hukuki ve ekonomik a\u00e7\u0131dan korunmas\u0131 amac\u0131yla bir dizi h\u00fck\u00fcmle d\u00fczenlenmektedir. Bu h\u00fck\u00fcmler aras\u0131nda kiralanan m\u00fclk\u00fcn durumu, kirac\u0131n\u0131n bor\u00e7lar\u0131, kiraya verenin haklar\u0131, kiraya verilen m\u00fclk\u00fcn durumu, s\u00f6zle\u015fmenin feshi gibi konular yer al\u0131r. Kiralama i\u015fleminin d\u00fczenlenmesinde, kiralanan mal\u0131n niteli\u011fi, kira bedeli, kiralama s\u00fcresi, kiraya verenin sorumluluklar\u0131 ve kirac\u0131n\u0131n haklar\u0131 gibi unsurlar\u0131n da g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gerekmektedir.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Kira hukuku ayr\u0131ca, kirac\u0131n\u0131n kira bedelini \u00f6dememesi, kiralanan m\u00fclk\u00fcn kullan\u0131m ama\u00e7lar\u0131na uygun olmamas\u0131, kira bedelinin zamlanmas\u0131 veya g\u00fcn\u00fcn\u00a0 \u015fartlar\u0131na uyarlanmas\u0131 gibi durumlarda fesih hakk\u0131na sahip olup, fesih hallerinin sonu\u00e7lar\u0131na dair h\u00fck\u00fcmler de i\u00e7ermektedir. Bu kapsamda, kirac\u0131n\u0131n s\u00f6zle\u015fmeyi feshetmesi ve kiralanan m\u00fclk\u00fc geri vermesi, kiraya verenin s\u00f6zle\u015fmeyi feshetmesi ve kiralanan m\u00fclk\u00fc geri almas\u0131 gibi sonu\u00e7lar s\u00f6z konusu olabilir.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Kira_Avukati_Nedir\"><\/span><strong>Kira Avukat\u0131 Nedir?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Kira avukat\u0131, kira hukuku konular\u0131nda uzmanla\u015fm\u0131\u015f ve kirac\u0131 veya m\u00fclk sahibi gibi taraflara hukuki dan\u0131\u015fmanl\u0131k ve temsil hizmeti sunan avukatt\u0131r. Kira avukatlar\u0131, kira s\u00f6zle\u015fmeleri, kira bedelleri, tahliye davalar\u0131, ihtarnameler, kirac\u0131 haklar\u0131, m\u00fclk sahibi haklar\u0131 gibi konularda m\u00fcvekkillerine yol g\u00f6sterir, hukuki s\u00fcre\u00e7leri takip eder ve gerekti\u011finde mahkemede m\u00fcvekkillerini temsil eder. Osmanl\u0131 d\u00f6nemindeki kira hukuku, g\u00fcn\u00fcm\u00fczdeki hukuki d\u00fczenlemelere benzer \u015fekilde, ta\u015f\u0131nmaz ve ta\u015f\u0131n\u0131r mallar\u0131n kiralanmas\u0131 i\u015flemini d\u00fczenlemekteydi.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Osmanl\u0131 d\u00f6nemindeki kira hukukunda, kiralama i\u015flemleri \u00f6ncelikle arazi ve binalar\u0131n kiralanmas\u0131 \u015feklinde ger\u00e7ekle\u015ftirilmekteydi. Bu kiralama i\u015flemleri genellikle arazi sahipleri ve \u00e7ift\u00e7iler aras\u0131nda yap\u0131lmakta, belirli bir \u00fccret kar\u015f\u0131l\u0131\u011f\u0131nda arazinin kullan\u0131m hakk\u0131 kirac\u0131ya devredilmekteydi. T\u00fcrk Bor\u00e7lar Kanunu&#8217;nda kira s\u00f6zle\u015fmeleri, detayl\u0131 \u015fekilde d\u00fczenlenmi\u015f ve taraflar\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fckleri net bir \u015fekilde belirlenmi\u015ftir.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Kanunun 299. maddesinde, kiralama i\u015fleminin tan\u0131m\u0131 yap\u0131lm\u0131\u015f ve kira s\u00f6zle\u015fmelerinin niteli\u011fi ve ko\u015fullar\u0131 belirtilmi\u015ftir.
